Is there any constitutional crisis in Sri Lanka ?

From what I gather one's stand on this will be based on one's view that

a) CJ is at fault totally and parliament is correct and is supreme in this impeachment and to accept it without question

b) parliament though representing the public , also includes humans whose judgement maybe clouded by their political agendas ( CJ is a political victim)

c) constitution is not clearly defined in this matter

d) when a controversy happens ( if we like it or not) we need to look into the root causes for the concern ( without denying it) . After unbiasedly clarifying facts against the present constitution , if the need be , revise it for a better democracy

My opinion : d)

Have anybody aware that similar impeachments have been submitted for almost all CJs in the history? If no, how do people come to know about the present one? CJ has become a clown among failed politicians. They want to find any means to overthrow the Government. CJ got caught to them according to me. It was the opposition suggested to remove her originally. Now Government is doing it.

Cj very clearly ask only for impartial inquiry

Politicians may try to use her for their political purposes
Even this poll
very clearly indicate general opinion of educated people Although the sample is very small

I genuinely feel this will be a problem for this govt in the near future

Govt can hang her if she is guilty after fair trial

Otherwise " ORUWA YANNE MAKARA KATATAY"

ALL of us will be in trouble

What is this? Everything has spelled in the constitution. If the constitution is wrong that had to be amended well in advance. Doesn't she aware as to how the disciplinary matters are conducted

???

can't you understand ? She cannot ASK for that and this.

The procedure is written and well practiced in several occasions before.

We have to understand the purpose of PSC. Actually , it is set as a supportive tool for the impeached person. Instead of debating and taking an instant decision after a resolution, the allegations are put to revived by a PSC before going ahead with it in the Parliament.

PSC is not a court. That is what these leaned professionals cannot or do not want to understand. By declaring it illegal doesn't change anything. All know it has no legal right to act as a court because that kind of power is not required to do its assigned tasks.

Politicians may try to use her for their political purposes

OMG ! Then keeping her in this position is extremely dangerous for the future of this country. !

?Does any one know the exact dates on which the said wrong acts relating to the three proven charges were committed by CJ, the reason for any delay in bringing the impeachment and the actual reason for the belated action by parliament. This will be an interesting set of data to judge the genuineness of the whole exercise.

There was a possibility that all these charges could go under the carpet if this actual reason didn't occure. ?How many such cases have been sent under the carpet by the present regime. What a shame?

We have discussed this in legnth.

I am concern about only 1 thing.

Given the same set of proved allegations for this impeachment against CJ, are there similar or worser guilty parties in high offices/parliament to these "crimes" who should get the same punishments. If there are, should politicians use their power to accuse and oust someone for what it appears as political conflict more than severe harm to the country.

I do not uphold CJ or any of the politicans. Wrong is wrong. I am only concerned whether CJ did serious damage to the country which cannot be punished or solved by other means or is this political bias.

People make rules. Rules can change ( constitution) if it does better for democracy of the country.Thats it.

Please leave partiality to any political party aside. Am asking a question only.

how can you blame the president. the one who appoints the CJ is president. if her conduct is unbecoming of a CJ ...president can remove her through the parliament process.

there were earlier instances and none of those were given publicity like this.

she has done more harm to the country....i dont understand why president wants to have review committee.

come january 11th she will be gone....

better for the GK depositors......and also must collect that discount what was given to her sister.......1.6

what i cant understand even in this forum the educated members say its presidents fault....how could that be......?

how could you remove CJ then.....

she influenced the president to appoint pradeep k for NSB.

she influenced the president to appoint pradeep k for NSB.
If she is a genuine educated respectable person she should have resigned by herself when her husband involved in this controversial NSB-TFC deal.I do not say she was guilty for husband's actions. But her position is one of the most honoured position in this country. So she should have kept that honour.I can remember some of the buggers who tries to safe guard her now telling various day dreaming things point a finger even to her at that time.
By participating on this political drama egostically CJ actually humiliate the entire judiciary system in this country.
Look at the bahaviour of Mr.Gamini Samaranayaka,Mr.Thilak Karunarathna,Even Mrs.Indrani Sugathadasa when they could not agree or work harmoniously with present government they themselves resigned without acting like cheap dirty politicians.

THERE IS NO CRISIS IN SRI LANKA

Sri Lanka Chief Justice Shirani Bandaranayake is impeached
http://www.bbc.co.uk/news/world-asia-20982990

11 January 2013 Last updated at 16:40 GMT
Lawyers hung a black flag as a sign of protest against the government's impeachment bid outside the Colombo court complex?

The Sri Lankan parliament has voted to remove Chief Justice Shirani Bandaranayake in a move analysts say could trigger a constitutional crisis.

The chamber, dominated by supporters of Sri Lanka's president, voted to impeach her by 155 votes to 49.

The government accuses her of corruption - an allegation she denies.

Recent court rulings said the process was unconstitutional, and she may refuse to leave. The president must now decide whether to enforce the sacking.

Critics of the government say that the judge is being victimised and the independence of the judiciary is being challenged. The government denies this.

The BBC's Charles Haviland in Colombo says that after the vote, supporters of the government took to the streets and rallied outside her official residence to celebrate her sacking.

Our correspondent says that recent rulings from the Supreme Court and the Court of Appeal have quashed the whole impeachment process, branding it "unconstitutional".

Reports say that the chief justice is already arranging her schedules for the next week in her current job in defiance of the vote.

The impeachment process has in recent weeks triggered protests by thousands of opposition supporters, lawmakers, lawyers and religious leaders.

It has also been criticised by human rights groups who have raised concerns over judicial integrity in the country.

Civil society activists and lawyers say it is a vendetta against a judge who was once favoured by the government but then made some rulings inconvenient to it.

They say the impeachment is aimed at swelling President Mahinda Rajapaksa's powers still further, and an umbrella group of lawyers has urged judges not to recognise any new chief justice imposed by the government.

The International Commission of Jurists has condemned the impeachment move, saying it erodes the rule of law and has caused a "constitutional crisis of unprecedented dimensions".

The United States has said it is "deeply concerned".

Dr Bandaranayake, 54, faced an 11-member parliamentary committee in November which investigated 14 charges of financial and official misconduct against her. She was found guilty of professional misconduct the following month.

More than 2/3 of the Parliament consists of representatives voted by public of Sri Lanka has agreed the removal of CJ.
As the first person of this country President should listen to the sound of public showed in the Parliament.Otherwise it is a great threat to democracy of this country.
As the President of people of Sri Lanka I think and hope President would agree to the desicion made by the Parliament as soon as possible. It is not wise to keep a person who has been rejected by 2/3 majority even another single day in her position.
