The US was the only member country to raise the issue of human rights violations in Sri Lanka in the time allotted for opening statements at the 22nd session of the United Nations Human Rights Council (UNHRC) in Geneva.

Neither Britain nor France mentioned the island nation although they had been in the forefront of the Western powers’ campaign to ensure civilian safety in the last and decisive phase of Eelam War IV in 2009. Germany did not speak about the rights situation in Lanka, but mildly rebuked the Lankan delegate for unfairly criticising the High Commissioner of Human Rights, Navanetham Pillai. India too avoided any mention of Lanka.

Germany had noted that Pillai, was “increasingly facing unjustified criticism” and cited the statement made by the Lankan delegate Mahinda Samarasinghe as an example.

In a forthright statement, the US said: “...Sri Lanka must promptly implement the constructive recommendations of the Lessons Learnt and Reconciliation Commission (LLRC). It must address accountability for violations of international law and investigate allegations of war crimes. We welcome the concerns of the Office of the High Commissioner for Human Rights about the government’s lack of genuine action on these issues as well as its recent efforts to undermine the independence of the judiciary and the rule of law. We stand ready, with OHCHR, to help Sri Lanka address outstanding issues related to reconciliation, democratic governance and accountability.”

On Thursday, the UNHRC disassociated itself from the screening of the Channel 4 film “No Fire Zone: The Killing Fields of Sri Lanka” on the UN premises by some NGOs on the sidelines of the 22nd session.

Following a protest letter from the Lankan Ambassador to the UN in Geneva, Ravinatha Aryasinha, president of the UNHRC, Remigiusz A Henczel, said that such events did not reflect the official position of the Council, New Indian Express reports.

Reluctance to Act against States

It is unclear, however, that nations would act forcefully for human rights. States somehow feel reluctant to punish errant states.
Reports indicate that India needs time to study the resolution. After watering down last year’s resolution as the price for its vote, if India now dithers on insisting on its implementation, it would seem that India is not ready to wield the immense responsibilities of a permanent seat on the Security Council. Tamil Nadu Governor K. Rosaiah, however, does not lack the resolve that his Prime Minister seems to. He urged Manmohan Singh to impose economic sanctions on Sri Lanka and take steps to ensure that those displaced by the ethnic conflict returned to their original homes and are allowed to live with dignity, self-respect and equal constitutional rights on par with the Sinhalese.
On the other hand, India’s former Chief Justice J. S. Verma was to arrive on a fact-finding mission for the International Bar Association, but Colombo cancelled his visa, The Sunday Island claimed, “out of respect for the former Chief Justice of India.” Yet Verma tried to save Colombo embarrassment, saying he himself cancelled the trip. But Colombo let him down in justifying the cancellation!
Jehan Perera predicts that Geneva will be a disappointment to those hoping that the UNHRC will insist on accountability, and that without new mechanisms, the resolution will reiterate the old, emphasizing its implementation. Betraying Colombo’s nervousness, this respected Perera who is circumspect and not given to histrionics, has had an intemperate tirade launched against him in an editorial by a once stately newspaper. Professional jealousy was evident in alluding to Perera gaining “a little learning at some Ivy League talk-shop,” meaning Harvard.
If India is not firm, South Africa could vote for Sri Lanka where it has growing investments, and influence other votes. Australia’s stand also seems vague as one branch of the federal government documented war crimes in Mullivaikaal, while another appeased Colombo to stop boat people.

Don't foget that their influence in Common-wealth Group & Euro Zone is enormous. Last time we lost because when india went with USA most non-alligned countries together with their friends turned back against us. We are not living in a vacuum.

එය ශ්‍රී ලංකාවට එරෙහි යෝජනාවක් ලෙසින් හඳුන්වා දීම කෙතරම් සාධාරණ දැයි විමසූ අවස්ථාවේ ඔහු කියා සිටියේ කිසියම් රටක මානව හිමිකම් වර්ධනය කළ යුතු බව කීම එම රටට කෙරෙන සතුරු කමක් නොවන බවයි.

කෙසේ නමුත් එම යෝජනාව ඉදිරිපත් කරන රටේ ක්‍රියාකාරිත්වය එයට පටහැනි නම් සහ ජාත්‍යන්තර වශයෙන් තවත් එවැනි උදාහරණ තිබියදී එක් රටකට පමණක් විශේෂ අවධානය යොමු කිරීම පිළිබඳව ප්‍රශ්නාර්ථයක් මතුවන බවයි.

Important steps taken by SL Govt. since end of war – UN Chief

I recognized the important steps taken by the Government of Sri Lanka since the end of the conflict, UN Chief Ban Ki Moon said in reply to a question on Sri Lanka during a press briefing. He added that he strongly underlined the need to address the remaining challenges particularly on issues relating to reconciliation and accountability.

Last week in New York I have received the Japanese ambassador who led the accountability assessment mission to Sri Lanka where representatives of Bangladesh, Nigeria, Rumania, Sri Lanka and a Colombia University professor participated in an observation project to Sri Lanka last December, the UN Chief added.

He also claimed that he had highlighted the importance for the Government of Sri Lanka to work constructively with the international community towards that end.

Excerpt of transcript of briefing;

Question: Thank you very much. Mr. Ban Ki-moon, I am a Mexican journalist and Vice-President of ACANU. It’s very nice to see you here in Geneva. Thank you very much for the opportunity of this press conference, on behalf of ACANU, I would like to say.

My question is regarding Sri Lanka. We just saw an appalling film that documents atrocities perpetrated at the end of the war. Members of the civil society made a strong statement demanding the Human Rights Council to ask for an international and independent investigation. Do you support this request?

Secretary-General: I have consistently underlined the critical importance of addressing accountability in Sri Lanka through a genuine and comprehensive national process achieving national reconciliation. Last week in New York I have received the Japanese ambassador who led the accountability assessment mission to Sri Lanka where representatives of Bangladesh, Nigeria, Rumania, Sri Lanka and a Colombia University professor participated in an observation project to Sri Lanka last December. This is international politics I think. USA knows very well that their proposal might boomarang on them one day if they continue to sing over Tamil diaspora tunes. When India, UK & Euro countries are not that hard on us USA needs an escape goat to fall in line. Ban Ki Moon just helps USA too to soft peddle. USA has other issues to deal with at home more than Tamil diaspora issues.
However, we need to amicably settle our internal issues so that no international preassure would intervene on us in the future. The million dollar question is ?whether our rulers understand importance of this. confused
