අභියාචනාධිකරණයේ මෙම නියෝගය පාර්ලිමේන්තු වරප්‍රසාද පනත සහ ආණ්‌ඩුක්‍රම ව්‍යවස්‌ථාව අභියෝගයට ලක්‌ කරන්නක්‌ බව නියෝජ්‍ය කථානායක චන්දිම වීරක්‌කොඩි මහතා "දිවයින ඉරිදා සංග්‍රහය" ට ප්‍රකාශ කළේය.

අධිකරණයේ කටයුතු අධිකරණය මගින් සහ ව්‍යවස්‌ථාදායකයේ කටයුතු පාර්ලිමේන්තුව මගින් පමණක්‌ ක්‍රියාත්මක කරවිය යුතු බවට අනුර බණ්‌ඩාරනායක මහතා කථානායකවරයා ලෙස මීට පෙර තීන්දුවක්‌ ලබා දී ඇතැයි ද එම තීන්දුව එවක අගවිනිසුරු සරත් එන් සිල්වා මහතා පිළිගත් බව ද චන්දිම වීරක්‌කොඩි මහතා කීවේය.

එසේ තිබියදී ශ්‍රේෂ්ඨාධිකරණය විසින් පසුගිය දිනෙක මේ හා සමානවම නොතිසි නිකුත් කිරීමක්‌ කර තිබූ බවත් වීරක්‌කොඩි මහතා අනුර බණ්‌ඩාරනායක මහතාගේ තීන්දුවට සමගාමී තීන්දුවක්‌ වර්තමාන කථානායක චමල් රාජපක්‍ෂ මහතා විසින් ද ලබාදුන් බව කීවේය.

පාර්ලිමේන්තු වරප්‍රසාද පනතේ නවවැනි වගන්තිය යටතේ සියලුම අධිකරණ මෙම තීන්දුව පිළිබඳ දැනුවත් විය යුතු බව ද ඒ පිළිබඳ විශේෂ දැනුවත් කිරීමක්‌ අවශ්‍ය නොවන බව ද කී නියෝජ්‍ය කථානායකවරයා කතානායක චමල් රාජපක්‍ෂ මහතා විසින් ලබා දී තිබෙන එම තීන්දුව අභියාචනාධිකරණයට ද වලංගු කළ බව කීය.

කථානායකවරයාගේ තීරණය ප්‍රකාරව සහ පෙර සිට පැවැති සම්ප්‍රදාය අනුව ඉහත කී විශේෂ කාරක සභාව පමණක්‌ නොව පාර්ලිමේන්තුවේ සියලුම කමිටු පාර්ලිමේන්තුවේම කොටසක්‌ සේ පිළිගැනෙන බව ද කීය.

ආණ්‌ඩුක්‍රම ව්‍යවස්‌ථාවට අනුව පාර්ලිමේන්තුව තුළ ක්‍රියාත්මක කටයුතු සම්බන්ධයෙන් කිසිදු තෙවන පාර්ශ්වයකට මැදිහත්විය නොහැකි බව ද එම නිසා අභියාචනාධිකරණයේ ඉල්ලීම පිළිගත යුතු නැතැයි ද නියෝජ්‍ය කථානායකවරයා පැවැසීය.

අධිකරණය හමුවේ පෙනී සිටින්නැයි අභියාචනාධිකරණය විසින් කතානායක වරයාගෙන් සහ විශේෂ කාරක සභාවෙන් කළ ඉල්ලීම පිළිබඳ විපක්‍ෂයේ පක්‍ෂ කිහිපයකින් විමසා සිටියදී ඔවුන් ප්‍රකාශ කළේ තම මතය පිළිබඳ මෙතෙක්‌ තීරණයක්‌ ගෙන නැති බවය.

" Independent committee" is to buy time but want solve the problem. And majority of people are clueless and believe what ever the gov media is saying..

It tantamount to Contempt of Court. Which is a jailable offence. So we could see the PSC members in jail unless there is parliamentary immunity. Parliment is there to enact legislations and judiciary is for implementation of law. Parliament can never act as the judiciary. It is a very simple rule of separation of powers which Branches out to legislature, executive and judiciary, this is what I learnt as a kindergarten student.

Mind you all the legislation that are executed by the judiciary is created or initiated by the Parliment (which have the representatives of the mass), So this is like son against the father Twisted Evil I'm not for or against the impeachment, Court only has the power to implement the law an order which is creted through the legislations by the parliament, and it's hilarious to see the top in the judiciary system (CJ) trying to get a verdict against the impeachment from the body (judiciary) she heads the top post.

Okay lets keep this simple. As a democracy, if a citizen of the country ( CJ) wants someone to hear his/her appeal after being tried in the parliament where will he/she go? Is there no way.

Someone ( legislature or Judiciary) is right here. Public does not remember or is aware of Events like what happened during (possible) CBK decision . But it should give a clear cut answer to this controversy. Or have we got into muddy water where no one is right ( or both are right) as there is "hidden door" out.

These things are documented in the Hansard. Someone needs to check it and execute it. Who will? Presidents new committee?

ව්‍යවස්ථාව අනුව පාර්ලිමේන්තුවට අධිකරණ බලයක් තිබුණේ පාර්ලිමේන්තු වරප‍්‍රසාද ප‍්‍රශ්නවලට අදාළව පමණය. ඒ බලයද පාර්ලිමේන්තුව විසින් පසුව සිය කැමැත්තෙන් අත්හරිමින් ඒ බලයද ශ්‍රේෂ්ඨාධිකරණය වෙත පවරන ලදි.

1978 වන තෙක්ම පාර්ලිමේන්තු වරප‍්‍රසාද විෂයේදීවත් පාර්ලිමේන්තුවට අධිකරණ බලයක් නොතිබුණි. ශ‍්‍රී ලංකාව පාර්ලිමේන්තු වරප‍්‍රසාද පනත් (1953 අංක 21 දරන පාර්ලිමේන්තු වරප‍්‍රසාද පනත) ඇති කරගනු ලැබුවේ 1953දීය. එම නීතිය යටතේ පාර්ලිමේන්තු වරප‍්‍රසාද ගණයට වැටෙන වැරදිවලට දඬුවම් දීමේ බලයක් පාර්ලිමේන්තුවට නොතිබුණු අතර පාර්ලිමේන්තු වරප‍්‍රසාද ප‍්‍රශ්නවලට අදාළ වැරදිවලදී පාර්ලිමේන්තුව විසින් ඒවා ශ්‍රේෂ්ඨාධිකරණයට යොමුකිරීමෙන් පසුව නඩු අසා දඬුවම් පැමිණවීමේ බලය පැවරී තිබුණේ ශ්‍රේෂ්ඨාධිකරණයටය.

1977 ජූලිවලදී පාර්ලිමේන්තුවේ හයෙන් පහක බලයක් සමග බලයට පත් එජාප ආණ්ඩුවේ අගමැති ජේ.ආර්. ජයවර්ධනට පාර්ලිමේන්තු වරප‍්‍රසාද ප‍්‍රශ්නවලදී ශ්‍රේෂ්ඨාධිකරණයට සමගාමීව නඩු අසා දඬුවම් පැමිණීමේ බලයක් පාර්ලිමේන්තුවට හිමිකර දීමට අවශ්‍ය වී 1978 ජනවාරිවලදී එතෙක් පැවති පාර්ලිමේන්තු වරප‍්‍රසාද පනත සංශෝධනය කෙරෙන අලූත් පනතක් (ජාතික රාජ්‍ය සභාවේ 1978 අංක 5 දරන පාර්ලිමේන්තු වරප‍්‍රසාද හා බලතල පිළිබඳ සංශෝධන පනත) සම්මත කරගත්තේය. එම පනත සංශෝධනය කරගත් දිනම සිලෝන් ඔබ්සර්වර් පුවත්පතේ පළවූ ඡුායාරූපයකට යොදා තිබුණු කැප්ෂනයක වරදක් අල්ලාගෙන එම පුවත්පතේ කර්තෘවරුන් දෙදෙනෙකුට එරෙහිව (හැරල්ඞ් පීරිස් හා උපාලි කුරේ) නඩු අසා ඔවුන්ට දඬුවම් කළේය. එහෙත් පාර්ලිමේන්තුව මේ බලය හැමවිටම පාවිච්චි නොකළේය. සමහර නඩු ශ්‍රේෂ්ඨාධිකරණය වෙත ඉදිරිපත් කළේය. නිදර්ශනයක් වශයෙන් හැරල්ඞ් පීරිස්ට හා උපාලි කුරේට දඬුවම් දෙන ලද ආකාරය විවේචනය කරමින් රාජනීතිඥ එස්. නඬේසන් මහතා සන් පුවත්පතට ලියන ලද ලිපි පෙළකට එරෙහිව නඬේසන් මහතාට එරෙහිව වරප‍්‍රසාද ප‍්‍රශ්නයක් මතු කරනු ලැබූවත් පාර්ලිමේන්තුව ඔහුට එරෙහිව නඩු අසා දඬුවම් කරන තැනකට ගියේ නැත. ඒ වෙනුවට නඬේසන් මහතා වරප‍්‍රසාද කඩකිරීමක් කර ඇති බවට තීන්දු කොට ඒ නඩුව ශ්‍රේෂ්ඨාධිකරණය ඉදිරියට යැවීය. එහෙත් තමන් කැමති වෙනත් නඩුවලදී නඩු අසා දඬුවම් කිරීමේ බලය පාර්ලිමේන්තුව පාවිච්චි කළේය. ඒ මගින් වැඩියෙන්ම බැටකන අය බවට පත්ව සිටියෝ ජනමාධ්‍යවේදීහුය.

මට එරෙහිව 1992 වසරේදී පාර්ලිමේන්තු වරප‍්‍රසාද ප‍්‍රශ්නයක් මතුවූ අවස්ථාවේදී පාර්ලිමේන්තුව පවත්වාගෙන යමින් සිටි නඩු අසා දඬුවම් කිරීමේ ප‍්‍රතිපත්තිය මම හබයට ලක් කළෙමි. නඩු ඇසීම සඳහා නීතියෙන් නියම කළ පටිපාටියක් නැතුව නඩු අසා දඬුවම් කරන ප‍්‍රතිපත්තියක් නීතියට පටහැනි බව මා මතු කළ තර්කය විය. මොන මොන හේතු නිසා පාර්ලිමේන්තුව මාගේ විරෝධය බුල්ඩෝසර් කරන ප‍්‍රතිපත්තියකට නොගොස් නීතිපතිගේ මතය විමසීම සඳහා මට එරෙහිව ආරම්භ කර තිබූ නඩුව දින නියමයකින් තොරව කල් දැමීය. ඉන්පසු චන්ද්‍රිකා කුමාරතුංග ආණ්ඩුව පාර්ලිමේන්තු වරප‍්‍රසාද නීතිය යටතේ නඩු අසා දඬුවම් කිරීමට පාර්ලිමේන්තුවට තිබූ බලය ඉවත් කොට ඒ බලය නැවත ශ්‍රේෂ්ඨාධිකරණයට ලබාදෙන ආකාරයට පාර්ලිමේන්තු වරප‍්‍රසාද නීතිය සංශෝධනය කළේය.

ඒ නිසා අගවිනිසුරු ශිරානි බණ්ඩාරනායක මහත්මියට එරෙහිව දෝෂාභියෝගයක් ඉදිරිපත් කරන අවස්ථාව වන විට නඩු අසා දඬුවම් කිරීමේ මොනම බලයක්වත් පාර්ලිමේන්තුවට නොතිබුණි. එය අගවිනිසුරු වෙනුවෙන් කරුණු ඉදිරිපත් කළ නීතිඥයන් සැලකිල්ලට නොගෙන තිබූ වැදගත් කරුණක් විය.

Whitebull, what you are saying applies mostly to a person who get a bad judgement after a trial or lack a good lawyer. Then there is appeal and supreme court. What you are stating is complex issue about inefficency of a legal system. These lapses in law can happen in any country and in any system.
(if one is persistent , I guess there are other options which I do nto want to state here. )

But the issue here is simpler. It is about parliament judgement without an appeal process.

By the way answer to your question is , as per my knowledge and thinking, he or she cannot and it is not necessary to appeal.

Because at that point he is a rejected person by the Parliament. No slstock I am talking about situation even after supreme and appeal court(lack of money does not come in to this but still other causes are there.) like in this CJ case.Lay person has to agree the decision of those higher courts like wise CJ has to agree to the decision of the parliment.

As this is for educational discussion ( as citizens fo Sri lanka) and not politics let me state one thing. What is the role of the supreme court and appeal court? As far as I know they check the legality of a lower court decision after an appeal is made ( correct me here someone who know more).

There is no option here for CJ right now. Agree to what the parliament committe said or resign. No opportunity to be given chance to say her side.

Court verdict or impeachment :

do we want to be accused of things without giving us an opportunity to explain? I would not be happy. I hope you see my point here.

Atleast she should be given a hearing in front of an impartial committee and an opportunity to reply to accusations or decide to resign( which is an option)

Again , I am talking civic right in a democratic society. I really think president should revisit this to show transparency of our society to the public and world. It will be wise.

IF CJ cannot prover her innocence after an appeal/impartial hearing she should be removed. CJ also has responsibility to uphold her postion and act upon the high trust placed on it.

What I understand , PSC is not acting as same as a court and it does not give verdicts.

It is an interim place to examine the allegations put forward by the members of parliament.

It's duty is to study and and give their observations and recommendations.
(am I correct ? )
President is the person who takes the decision.

The officer gets the chance to explain and talk behalf of him at PSC. In the current case she went there several days. I do not know why a person of that caliber could not counter attack and nullify the facts shown by the PSC as written proofs of her misconduct.
I think there is no provision and it is useless to cross examine the witnesses at PSC like in a normal court. A PSC normally deals with written proofs.

To us this may look like unfair. We can suggest proper ways. But this is the procedure written in the 1978 constitution and it deals with top rank people. Normally expected way was if the officer cannot show his innocence at PSC to resign from the post.

What gurantee have we got that impartial commottee would be truely impartial ? This may be an endless matter if this is dragged.So in my opinion I think this should end at the level of parliament.If CJ do not agree to the decision made by public representatives then she should go to the decision of actual public ie an election whether to romove or keep the CJ Wink

ඒ අනුව මෙම පැමිණිල්ල සම්බන්ධයෙන් කරුණු දැක්වීම සඳහා ලබන ජනවාරි 03 වැනි දින අධිකරණය ඉදිරියේ පෙනී සිටින මෙන් අභියාචනාධිකරණය කතානායකවරයාට සහ පාර්ලිමේන්තු තේරීම් කාරක සභාවේ සාමාජිකයන්ට නොතීසි ද නිකුත් කළේය.

කතානායක චමල් රාජපක්ෂ මීට කලින් තීන්දු කොට තිබුනේ පාර්ලිමේන්තුව උත්තරීතර බැවින් අධිකරණයේ නොතීසි පිලිපැදීමට පාර්ලිමේන්තුව බැඳී නැති බවයි.

කෙසේ නමුත් එම ප්‍රකාශය පිළිගත නොහැකි බව පැවසූ අධිකරණය සාධාරණ නඩු විභාගයක් පැවැත්වීම පිණිස එවැනි නොතීසියක් නිකුත් කිරීමට ව්‍යවස්ථාව මගින් තමන්ට බලය ලබා දී තිබෙන බවද පැවසීය.

පෙත්සම් විභාගය ජනවාරි 03 වැනිදාට කල් දැමූ අභියාචනාධිකරණය, පෙත්සම් විභාගය අවසන් වනතුරු දෝෂාභියෝගය සම්බන්ධයෙන් කිසිදු පියවරක් නොගන්නා මෙන් කතානායකවරයාට දැනුම් දුන්නේය.

පසුගිය දෙසැම්බර් 08 වැනි දින කතානායකවරයාට භාරදුන් දෝෂාභියෝග විමර්ශන වාර්තාව පිළිබඳව පාර්ලිමේන්තුව ලබන ජනවාරි මාසයේදී විවාද කිරීමට නියමිතව තිබිණ.

Prorogue Parliament to settle crisis: UPFA allies

Leaders of three socialist parties, which are coalition partners of the ruling UPFA, have asked President Mahinda Rajapaksa to prorogue Parliament as a way out of the impasse between the Judiciary and the Legislature over moves to impeach the Chief Justice.

LSSP leader and Minister Tissa Vitarana, CP leader and Minister D.E.W. Gunasekera, and DLF leader and Minister Vasudeva Nanayakkara have told the President that a prorogation will help ease the escalation of growing tension over the impeachment move and allow both sides to re-think the situation.

The Sunday Times learns that the three ministers have said that as pending business would lapse with a prorogation, such a move would allow the President and the Government to change Standing Orders and make provision for an independent panel to inquire into the charges against the Chief Justice.�President Mahinda Rajapaksa had been non-committal to the suggestion, the spokesman said.

Speaker Chamal Rajapaksa in a ruling earlier this month in Parliament rejected the notices issued on him and the members of the PSC by the Supreme Court and had added that his ruling would apply to “any similar purported Notice, Order of Determination in respect of the proceedings of the Parliamentary Select Committee (PSC). But the Court of Appeal on Friday issued notice on the Speaker, the members of the Committee and the Secretary General of Parliament.

A Parliament official confirmed that the notices had been received on Friday and said the decision on whether the Secretary General would appear before court or not could be taken after consultations with the Speaker.

Principles of natural justice or procedural fairness:

Fairness – decisions will be made on the basis of a set of established rules that are known. For example, if there were no laws about smoking at work, it would be unfair for a person who smoked at work to be punished by the legal system.

Transparency – what happens in the legal system can be seen and understood by the general public, that courts and tribunals are open to the public, rather than their decisions being made behind closed doors.

Equality before the law – each person should be treated in the same way by the legal system no matter who they are. For example, the legal system must not make a different decision because a person is richer or poorer than another person, or because a person comes from another country. It means that everyone should be able to access the law and the legal system equally. It also means that the law applies equally to everyone. No person is above the law, no matter what position they hold in society.

Freedom from bias – a decision maker must not have a personal interest in the decision she or he is making and must not prefer one person over another when they are making a decision. Another word for this is ‘impartiality’. For example, a judge must not be involved in deciding a case where one of the people involved is a family member, doctor or friend.

The right to be heard – a person who is affected by a decision made by the legal system has a right to present their views and facts that support that view (evidence) to the decision maker before the decision is made. It also means that a person who is accused of doing something wrong has a right to be told what it is they are said to have done wrong and to be shown the evidence against them so that they can defend themselves against the accusation.

There is no option here for CJ right now. Agree to what the parliament committe said or resign. No opportunity to be given chance to say her side.

Court verdict or impeachment :

do we want to be accused of things without giving us an opportunity to explain? I would not be happy. I hope you see my point here.

Atleast she should be given a hearing in front of an impartial committee and an opportunity to reply to accusations or decide to resign( which is an option)

Again , I am talking civic right in a democratic society. I really think president should revisit this to show transparency of our society to the public and world. It will be wise.

IF CJ cannot prover her innocence after an appeal/impartial hearing she should be removed. CJ also has responsibility to uphold her postion and act upon the high trust placed on it.

No slstock I am talking about situation even after supreme and appeal court(lack of money does not come in to this but still other causes are there.) like in this CJ case.Lay person has to agree the decision of those higher courts like wise CJ has to agree to the decision of the parliment.

පිකරින්ගේ දෝෂාභියෝග නඩුවේදී ඇමරිකාවේ සෙනෙට්‌ සභාව යම් යම් නිගමනවලට පැමිණියේය. මින් එක්‌ නිගමනයක්‌ වූයේ සෙනෙට්‌ සභාව ඉදිරියේ දෝෂාභියෝගයට ලක්‌ වන පුද්ගලයාව සිරභාරයට ගැනීමට හෝ සිර අඩස්‌සියේ තබාගැනීමට ව්‍යවස්‌ථාවෙන් සෙනෙට්‌ සභාවට බලය පවරා නැති බවයි. දෙවැනි නිගමනය වූයේ සෙනෙට්‌ සභාව විසින් අදාළ විත්තිකරුවාට ඔහුට එරෙහිව දෝෂාභියෝගයක්‌ තිබෙන බවත් එහි චෝදනා මොනවාද යන්න පිළිබඳවත් දැනුම්දීමක්‌ පමණක්‌ කළ යුතු බවයි. තුන් වැනි නිගමනය වූයේ එම චෝදනාවලට පිළිතුරු දීමට විත්තිකරුවා පුද්ගලිකව පෙනී සිටිනවාද නැති නම් නීතිඥයන් මාර්ගයෙන් පෙනී සිටිනවාද නැති නම් පෙනී සිටින්නේ නැත් ද යන්න අදාළ පුද්ගලයාගේ පෞද්ගලික තෝරා ගැනීමක්‌ බවයි. සිව් වැනි නිගමනය වූයේ පෙර කී පරිදි අදාළ පුද්ගලයාට එරෙහිව දෝෂාභියෝගයක්‌ තිබෙන බව දැනුම් දීමෙන් පසු අදාළ පුද්ගලයා පුද්ගලිකව හෝ නීතිඥයකු මාර්ගයෙන් හෝ සෙනෙට්‌ සභාව ඉදිරියේ පෙනී සිටියාත් නැතත් සෙනෙට්‌ සභාව විසින් අදාළ දෝෂාභියෝගය විභාග කොට තීන්දුව ද ප්‍රකාශයට පත් කළ යුතු බවයි.

ඇත්ත වශයෙන්ම එම නඩුවේදී සිදු වූයේ ජෝන් පිකරින් ට ඔහුට එරෙහිව ඇති දෝෂාභියෝග පිළිබඳව දැනුම්දීමක්‌ කළ ද ඔහු සෙනෙට්‌ සභාව ඉදිරියේ පුද්ගලිකව පෙනී සිටියේත් නැත. නීතිඥයකු එව්වේත් නැත. වෙනකක්‌ තබා තමාට එරෙහිව ඇති චෝදනාවලට ලිත පිළිතුරු එව්වේත් නැත. සෙනෙට්‌ සභාවේ විමර්ශනය ආරම්භ වී දින 10 ක්‌ ඇතුළත ඔහු වරදකරු බවට තීන්දුව දෙන ලදී. ඇමරිකා එක්‌සත් ජනපදයේ 99 වැනි කොංග්‍රස්‌ මණ්‌ඩලය විසින් 1986 අගෝස්‌තු 15 වැනිදා "සෙනෙට්‌ සභාව ඉදිරියේ දෝෂාභියෝග විභාග කිරීම සඳහා ක්‍රියාපටිපාටිය" යන මැයෙන් ලියවිල්ලක්‌ නිකුත් කරන ලදී. සෙනෙට්‌ සභාව ඉදිරියේ කෙරීගෙන යන දෝෂාභියෝග ක්‍රියාදාමයක්‌ ඉදිරියේ අදාළ විත්තිකරුවා පෙනී සිටීම හෝ නොසිටීම පිළිබඳව කියා ඇත්තේ මෙවැනි දෙයකි. "දෝෂාභියෝගයට ලක්‌වන පුද්ගලයාට එවැන්නක්‌ ඇති බවට දැනුම් දීමෙන් පසු ඔහු පුද්ගලිකව නැතිනම් නීතිඥයකු මාර්ගයෙන් අදාළ දිනයේදී සෙනෙට්‌ සභාව ඉදිරියේ පෙනී නොසිටිය හොත් නැති නම් පෙනී සිට ඔහුට එරෙහිව ඇති චෝදනාවලට උත්තර බැඳීමෙන් වැළකී සිටිය හොත් තමා නිර්දෝශී යෑයි කියා සිටියාය යන උපකල්පනය මත පිට සෙනෙට්‌ සභාවේ විභාගය කෙරීගෙන යා යුතුය." මේ අනුව ලංකාවේ පාර්ලිමේන්තු ස්‌ථාවර නියෝග හා ඇමරිකානු සෙනෙට්‌ සභාවේ දෝෂාභියෝග ක්‍රියාපටිපාටිය එකට ගෙන බැලූ කල විත්තිකරු විභාගය හමුවේ පෙනී සිටියත් නැතත් එය දිගටම කරගෙන යාමට කිසිදු බාධාවක්‌ නැති බව අපට පෙනේ.

දෝෂාභියෝග ක්‍රියාදාමය පිළිබඳව තමාට විශ්වාසයක්‌ නැතැයි කියමින් එය හැර යැමෙන් අග්‍රවිනිශ්චයකාරතුමිය වෙනමම දෝෂාභියෝගයකට ලක්‌ කළ හැකි තවත් වරදක්‌ කළා විය හැක. එයට හේතුව එතුමිය ප්‍රධානත්වය දරන අධිකරණයට නීත්‍යානුකූලභාවය ලබාදෙන ව්‍යවස්‌ථාවෙන්ම බලය ලබන ක්‍රියාදාමයකින් රටේ අගවිනිසුරු හැටියට ඇය ඉවත්ව යැමෙන් රටේ ව්‍යවස්‌ථාව හෑල්ලුවට ලක්‌ කළා ද යන්නයි. නමුත් එතුමිය අතරමගදී මේ ක්‍රියාදාමය හැර යාම එක පැත්තකින් මවිතයට කාරණයක්‌ ද නොවේ. ඇයට එරෙහිව ඇති ඇතැම් චෝදනාවලට උත්තර බැඳිය නොහැක. දෝෂාභියෝගයේ පළමු හා පස්‌ වැනි චෝදනා සම්බන්ධයෙන් ඇති තත්ත්වය අප ඉකුත් සතියේ පැහැදිලි කෙරුවෙමු. අගවිනිසුරුතුමිය ඉකුත් බ්‍රහස්‌පතින්දා තේරීම් කාරක සභා ක්‍රියාදාමයෙන් ඉවත්ව යන මොහොතේ මා සිටියේ පේරාදෙණිය විශ්වවිද්‍යාලයේ නීති පීඨයේ ආචාර්ය දීපිකා උඩුගමගේ දේශනයකට සවන් දෙමිනි. මා එම සම්මන්ත්‍රණයේදී ඇසුවේ එක ප්‍රශ්නයකි. ඒ අග්‍රවිනිශ්චයකාරතුමියගේ ස්‌වාමිපුරුෂයා මහෙස්‌ත්‍රාත් උසාවියක පවරා ඇති නඩුවක සැකකරුවකු වශයෙන් සිටින අතරතුර අග්‍රවිනිශ්චයකාරතුමිය අගවිනිසුරු තනතුරේ පමණක්‌ නොව එම තනතුරටම බැඳී ඇති අධිකරණ සේවා කොමිසමේ ද සභාපතිත්වයේ සිටීමෙන් ගැටුමක්‌ ඇතිවන්නේ නැත් ද යන්නයි. ඒ ගැටුම වඩාත් තීව්‍ර වන්නේ අධිකරණ සේවා කොමිසමට අගවිනිසුරුතුමියගේ ස්‌වාමිපුරුෂයාගේ නඩුව අසන මහෙස්‌ත්‍රාත්වරයා මාරු කිරීම, උසස්‌ කිරීම, විනය පරීක්‍ෂණ කිරීම හා සේවයෙන් දොට්‌ට දැමීමට පවා හැකි වන අතර ඔහුගේ උසාවියේ ඇති සියලුම ලියකියවිලි ගෙන්වා පරීක්‍ෂණයට ලක්‌ කළ හැකි වීමෙනි. අග්‍රවිනිශ්චයකාරතුමියගේ ස්‌වාමිපුරුෂයා පැටලී සිටින්නේ ද සුළුපටු ප්‍රශ්නයකට නොව ජනමාධ්‍යයේ පළවූ ජාතික ඉතිරි කිරීමේ බැංකුවේ වෘත්තීය සමිති වල උද්ඝෝෂණයට ලක්‌ වුණු පාර්ලිමේන්තුවේ කථාවුණු මුළු රටම ගඳගස්‌වපු හා ජනාධිපතිතුමා පුද්ගලිකවම මැදිහත් වී නිෂ්ප්‍රභ කරන ලද ගනුදෙනුවක්‌ සම්බන්ධයෙනි. විපක්‍ෂ මන්ත්‍රී ආචාර්ය හර්ෂ ද සිල්වා තම ස්‌වාමිපුරුෂයාගේ මේ ගනුදෙනුව නිසා අගවිනිසුරුතුමිය ඉල්ලා අස්‌විය යුතු යෑයි ප්‍රකාශ කර සිටියේ මීට මාස හතකට පමණ කලින්ය.

මා ඇසූ ගැටුම පිළිබඳ ප්‍රශ්නයට උත්තර දුන්නේ ආචාර්ය උඩුගම නොව මූලාසනයේ සිටි ආචාර්ය ජයම්පති වික්‍රමරත්නය. ඔහු මෙහිදී පවසා සිටියේ අගවිනිසුරුතුමියගේ ස්‌වාමිපුරුෂයාගේ නඩුව අසන මහෙස්‌ත්‍රාත්වරයා සම්බන්ධ යම් ප්‍රශ්නයක්‌ අධිකරණ සේවා කොමිසම ඉදිරියට පැමිණිය හොත් අග්‍රවිනිශ්චයකාරතුමිය එම සාකච්ඡාවේදී කොමිසමේ අසුන් නොගෙන අනෙක්‌ විනිශ්චයකාරවරුන් දෙදෙනාට අදාළ තීන්දුව ගැනීමට ඉඩ දීමෙන් මේ ගැටුම නිරාකරණය කළ හැකි බවයි. නමුත් මා මෙහිදී පෙන්වා දුන්නේ කොමිසමේ සභාපති අකැමැති නිගමනයකට අනෙක්‌ විනිශ්චයකාරවරුන් දෙදෙනා පැමිණේවි යෑයි කිසි ලෙසකින් උපකල්පනය කළ නොහැකි බවත් අග්‍රවිනිශ්චයකාරවරයාගේ ස්‌වාමි පුරුෂයා චූදිතයා වන නිසා මහෙස්‌ත්‍රාත් උසාවියේ නඩුව මුල සිටම විකෘති වන බවයි. මෙයට කිසිවකුත් පිළිතුරු දුන්නේ නැත. දීමට පිළිතුරක්‌ ඇත්තේ ද නැත.

පාර්ලිමේන්තු කාරක සභාවේ සිටි විපක්‍ෂ සාමාජිකයකු වන ලක්‍ෂ්මන් කිරිඇල්ල පෙන්වා දුන් එක්‌ කාරණයක්‌ වූයේ අග්‍රවිනිශ්චයකාර වරියට තමාට එරෙහිව ඇති චෝදනා වලට උත්තර බැඳීමට අවශ්‍ය තරම් කාලයක්‌ ලබා නොදුන් බවයි. ඔහු පෙන්වා දුන්නේ හරක්‌ හොරෙකුට වුවත් උත්තර බැඳීමට මාස තුනකවත් කාලයක්‌ ලබාදෙන බවයි. නමුත් අප කලින් පෙන්වා දුන් පරිදි දෝෂාභියෝගයක්‌ යනු අපරාධ නඩුවක්‌ නොව හුදෙක්‌ම විනය පරීක්‍ෂණයක්‌ වැනි කටයුත්තකි. මේ සම්බන්ධයෙන් ඇති ක්‍රියා පටිපාටිය ගැනද ඇතැම් අය තුළ වැරදි වැටහීමක්‌ ඇති බව පෙනේ. දෝෂාභියෝගයක්‌ විභාග කළ යුත්තේ පාර්ලිමේන්තු මන්ත්‍රීවරුන් නොව විනිශ්චයකාරවරුන් යෑයි තර්කයක්‌ ඉදිරිපත් වී ඇත. මා ඉහත සඳහන් කළ සම්මන්ත්‍රණයේදී ලංකාවේ ප්‍රමුඛ පෙලේ දේශපාලන ක්‍රියාකාරිකයකු වන එල්මෝ පෙරේරා මහතා පවසා සිටියේ ඇමරිකාවේ සෙනෙට්‌ සභාව විසින් දෝෂාභියෝගයක්‌ විමර්ශනය කරනවිට එහි සභාපතිත්වය දරන්නේ අග්‍රවිනිශ්චයකාර වරයා බවයි. එම සම්මන්ත්‍රණයේ සිටි එක්‌ පුද්ගලයෙක්‌ ඇමරිකාවේ අග්‍රවිනිශ්චයකාර වරයා දෝෂාභියෝගයකට ලක්‌වුවහොත් එය විභාග කරන්නේ කවුදැයි යන ප්‍රශ්නයට ආචාර්ය දීපිකා උඩුගමටවත් ආචාර්ය ජයම්පති වික්‍රමරත්න මහතාටවත් එල්මෝ පෙරේරා මහතාටවත් පිළිතුරක්‌ තිබුණේ නැත. ඇත්ත තත්ත්වය නම් ඇමරිකා එක්‌සත් ජනපදයේ සෙනෙට්‌ සභාව ඉදිරියේ දෝෂාභියෝග විභාගයකදී අග්‍රවිනිශ්චයකාරවරයා සභාපතිත්වය දරන්නේ ජනාධිපතිවරයකු දෝෂාභියෝගයට ලක්‌වන විට පමණි. අගවිනිසුරුවරයා හෝ වෙනත් විනිශ්චයකාරවරයකු දෝෂාභියෝගයට ලක්‌වන්නේ නම් අදාළ විභාගය සිදුකරන කමිටුවේ සභාපතිත්වය දරන්නේ සාමාන්‍ය සෙනෙට්‌ මන්ත්‍රීවරයෙකි. ඇමෙරිකාවේ අවසන් වරට විනිශ්චයකාවරයකු දෝෂාභියෝගයට ලක්‌කරන ලද්දේ මීට අවුරුදු දෙකකටත් පෙරය. ඒ අවස්‌ථාවේදීද විභාගය සිදුකළ කමිටුවේ සභාපතිත්වය දැරුවේ සාමාන්‍ය මන්ත්‍රීවරයෙකි.

මේ ආකාරයට අවසන් වරට දෝෂාභියෝගයට ලක්‌ වුණු තෝමස්‌ පෝමියස්‌ විනිශ්චයකාරවරයා සෙනෙට්‌ කමිටුවේ විභාගය අතරතුර ලංකාවේ අගවිනිසුරු ශිරාණි බණ්‌ඩාරනායක මැතිනිය ඉදිරිපත් කරන ආකාරයේම තර්ක ඉදිරිපත් කළේය. පෝමියස්‌ විනිශ්චයකාර තුමාගේ එක තර්කයක්‌ වූයේ සෙනෙට්‌ සභාවට ඔහුව විභාග කළ නොහැකි බවත් එය කළ යුත්තේ අධිකරණ දෙපාර්තමේන්තුව විසින් බවත්ය. මේ සම්බන්ධයෙන් ඇමරිකානු කොංග්‍රස්‌ මණ්‌ඩලයේ නියෝජිත මන්ත්‍රී මණ්‌ඩලය දුන් පැහැදිලි තීන්දුව වූයේ විනිශ්චයකාරවරයකුගේ හැසිරීම විභාග කොට ඔහුව තනතුරෙන් පහ කිරීමේ බලය ව්‍යවස්‌ථාවෙන් දී ඇත්තේ සෙනෙට්‌ සභාවට මිස අධිකරණ දෙපාර්තමේන්තුවට නොවන බවයි. මේ සම්බන්ධයෙන් කරන ලද වැඩිදුර සටහනේ ඇමරිකානු නියෝජිත මන්ත්‍රී මණ්‌ඩලය ඇමරිකා එක්‌සත් ජනපදය එරෙහිව නික්‌සන් යන සුප්‍රසිද්ධ නඩුව කෙරෙහිද අවධානය යොමුකර තිබිණි.

ඇමරිකා එක්‌සත් ජනපදය එරෙහිව නික්‌සන් යනු 1993 ඇමරිකානු ශ්‍රේෂ්ඨාධිකරණය ඉදිරියේ විභාග වූ නඩුවකි. මෙම නඩුව පවරා තිබුණේ දෝෂාභියෝගයට ලක්‌වූ ජ්‍යෙෂ්ඨ විනිශ්චයකාර වරයකු වූ වෝල්ටර් ඡේ. නික්‌සන් මහතාය. ඔහුගේ ප්‍රධාන තර්කය ලංකාවේ අද ඇතිවී තිබෙන මේ විවාදයට බෙහෙවින්ම සමානය. ඔහු තර්ක කළේ ව්‍යවස්‌ථාදායකයට අධිකරණ බලයක්‌ ක්‍රියාත්මක කළ නොහැකි බවයි. මේ නඩුවේ තීන්දුව දෙමින් එකල ඇමරිකානු අගවිනිසුරු රෙන් ක්‌විස්‌ට්‌ මහතා ඇමරිකානු ව්‍යවස්‌ථාවේ නිර්මාතෘවරුන් විසින් දෝෂාභියෝග විභාග කිරීමේ බලතල අධිකරණයට නොදී සෙනෙට්‌ සභාවට දෙනු ලැබුවේ මන්ද යන්න ගැන සමාලෝචනයක්‌ කරන ලදී.

ඔහු පෙන්වා දුන්නේ ඇමරිකානු ව්‍යවස්‌ථාවේ නිර්මාතෘවරුන් දෝෂාභියෝග විභාග කළ යුත්තේ කවුරුන්ද යන්න ගැන දීර්ඝ වශයෙන් විවාද කළ බවත් එකල ව්‍යවස්‌ථාදායක සමුළුවේ ප්‍රබල සාමාජිකයකු වූ ඡේම්ස්‌ මැඩිසන් යෝජනා කළේ සියලු දෝෂාභියෝග විභාග කිරීම ශ්‍රේෂ්ඨාධිකරණයට භාර දිය යුතු බවයි. නමුත් අවසානයේදී ව්‍යවස්‌ථා සම්පාදන සමුළුව තීන්දු කලේ දෝෂාභියෝග විභාග කිරීමේ බලතල සෙනෙට්‌ සභාවට පමණක්‌ ලබාදිය යුතු බවටය. ව්‍යවස්‌ථාව සම්පාදනය කරන ලද සමුළුව එකී බලය සෙනෙට්‌ සභාවට දීමට ප්‍රධානම හේතුව සෙනෙට්‌ සභාව සමන්විත වූයේ ජනතා නියෝජිතයන්ගෙන් වීමයි. දෝෂාභියෝගයක්‌ වැනි වැදගත් කර්තව්‍යයක්‌ ඉටුකිරීමට ශ්‍රේෂ්ඨාධිකරණයට සුජාත බවක්‌ තිබේද යන්න ගැන ව්‍යවස්‌ථා සම්පාදක වරුන්ටද සැකයක්‌ තිබිණි. (ඇමරිකාවේ ජනාධිපතිවරයා පවා දෝෂාභියෝගයට ලක්‌කිරීම මේ බලයට අදාළ වූ නිසාය.) රටේ ඉහළම පුද්ගලයන්ට එරෙහිව දෝෂාභියෝගයක්‌ ගෙන එන විට ජනතා නියෝජිතයන්ගෙන් සමන්විත සභාවකට ජනතාව ඉදිරියේ ඇති සුජාත භාවය වැඩිබව ඉතා තීක්‍ෂණ බුද්ධියකින් යුතුව ඇමරිකානු ව්‍යවස්‌ථා සම්පාදකයන් දුටුවේය. එපමණක්‌ද නොව දෝෂාභියෝගයේ චෝදනාව ගෙන එන්නේ ජනතාව නියෝජනය කරන ව්‍යස්‌ථාදායකයේ කොටසක්‌ වන නියෝජිත මන්ත්‍රී මණ්‌ඩලයෙන් වන නිසා ඔවුන් ගෙන එන චෝදනාවකට එරෙහිව තීන්දුවක්‌ දීමට ජනතාවගේ නියෝජිතයන් නොවන ශ්‍රේෂ්ඨාධිකරණය වැනි ආයතනයකට සුජාත භාවයක්‌ තිබේද යන ප්‍රශ්නයක්‌ පැන නැගුණි. ඇමරිකානු ව්‍යවස්‌ථා සම්පාදකයන් විසින් දෝෂාභියෝග විභාග කිරීමේ බලය අධිකරණයට නොදී සෙනෙට්‌ සභාවටම දීමට තවත් ප්‍රබල හේතුවක්‌ තිබිණි. ඒ රටේ ඉහළම තනතුරු දරන පුද්ගලයන්, ජනාධිපතිවරයා පවා ඉවත් කිරීමේ බලය ශ්‍රේෂ්ඨාධිකරණය වැනි පුද්ගලයන් කීපදෙනකුගෙන් පමණක්‌ සමන්විත ආයතනයකට නොදී ජනතාව සෘජුවම නියෝජනය කරන ඊට වඩා පුළුල් හා විශාල පුද්ගලයන් ගණනක්‌ සිටින ආයතනයකට දීම උචිතය යන කාරණයයි.

දෝෂාභියෝග විභාග කිරීමේ බලතල ශ්‍රේෂ්ඨාධිකරණයට නොදී සෙනෙට්‌ සභාවට දීමට තවත් හේතුවක්‌ද විය. ඒ දෝෂාභියෝගයට ලක්‌වන පුද්ගලයාට එරෙහිව ක්‍රියාපටිපාටි දෙකක්‌ තිබීමට ඇති ඉඩකඩයි. එක පැත්තකින් දෝෂාභියෝගයට ලක්‌වන පුද්ගලයා එම චෝදනා සම්බන්ධයෙන්ම ඇතැම් අවස්‌ථා වල වෙනම අපරාධ නඩුවකටද ලක්‌වීමට ඉඩ ඇත. එම නිසා දෝෂාභියෝග විභාගයත් එම චෝදනා වලටම අදාළ අපරාධ නඩුවත් එකම ආයතනය විසින් නොකළ යුතුය යන මූලධර්මය මත දෝෂාභියෝග විභාග කිරීමේ බලය සෙනෙට්‌ සභාවට දී තිබිණි. එක්‌සත් ජනපදය එරෙහිව නික්‌සන් යන නඩුවේදී තවදුරටත් කථා කරමින් ඇමරිකානු අගවිනිසුරු රෙන්ක්‌විස්‌ට්‌ මහතා දෝෂාභියෝග විභාගයකදී සෙනේට්‌ සභාව ගන්නා තීන්දුවක්‌ පසුව කිසිදු අධිකරණයකදී ප්‍රශ්ණ නොකල යුත්තේ මන්ද යන්න ගැනද පැහැදිලි කර සිටියේය. ඔහු පෙන්වා දුන්නේ සෙනෙට්‌ සභාවෙන් ගන්නා තීන්දුවක්‌ අධිකරණයට ප්‍රශ්න කිරීමේ බලය ලබාදීමෙන් සිදුවන්නේ දෝෂාභියෝග විමර්ශනය කිරීමේ බලයක්‌ අධිකරණයට ලැබීම බවයි. එම නිසා අධිකරණය එම ක්‍රියාදාමයෙන් සම්පූර්ණයෙන් වෙන්කොට තැබීමට නම් සෙනෙට්‌ සභාවේ තීන්දුව ප්‍රශ්නයට ලක්‌කිරීමට අධිකරණයට නොහැකි විය යුතු බවයි. තවද ඔහු පෙන්වා දුන්නේ ඇමරිකානු ව්‍යවස්‌ථාවට අනුව ( හා අපේ ව්‍යවස්‌ථාව ද අනුව) ව්‍යවස්‌ථා දායකයට අධිකරණය සම්බන්ධයෙන් යම් පාලන බලයක්‌ ලැබෙන්නේ මේ දෝෂාභියෝග ක්‍රියාදාමය තුලින් පමණක්‌ බවයි. එම නිසා දෝෂාභියෝග විභාග කිරීමේ බලය අධිකරණයට ලබාදීමෙන් පාලනයකට ලක්‌විය යුතු ආයතනයටම ඒ බලය ලබාදීම යන ජුගුප්සා ජනක තත්ත්වය ඇතිවන බවයි. ඇමරිකාවේ සෙනෙට්‌ සභාව, නියෝජිත මන්ත්‍රී මණ්‌ඩලය හා ශ්‍රේෂ්ඨාධිකරණය වෙන වෙනම නොයෙක්‌ අවස්‌ථා වල දෝෂාභියෝග විභාග කිරීමේ බලතල අධිකරණයට භාර නොදී ව්‍යවස්‌ථාදායකට භාරදිය යුත්තේ ඇයි ද යන්න ගැන කී කාරණා ලංකාවටද බෙහෙවින්ම වැදගත් වන බව අමුතුවෙන් කිව යුතු නැත.
