The Supreme Court yesterday re-fixed, for May 28, the appeal, filed by the Ceylon Tobacco Company, against an Appeal Court refusal to suspend the Gazette notification making it compulsory to carry pictorial warnings on 80 per cent of all cigarette packs.
The Supreme Court’s decision to re-fix the case was subsequent to the appellant, Ceylon Tobacco Company Private Limited and the respondent, the Minister of Health being unable to reach a settlement in respect of the dispute over the gazette notification.
The gazette notification will not take effect till that date.

The Deputy Solicitor General Janaka de Silva appeared for the Minister of Health. The Supreme Court Bench comprised Chief Justice Mohan Pieris, Justice Chandra Ekanayake and Justice Priyasarth Dep.
